Procedures to File a Complaint

Policy: Uniform Complaint Procedures

 

Consultation Before Filing:

Reasons to File:

  • Failure to comply with State or Federal programs Complaints Educational Equity complaints (unlawful discrimination, harassment, intimidation, or bullying of a protected group)
  • Complaints regarding unlawful pupil fees
  • Federal & State Categorical Aid Programs
  • Local Control Funding Formula (LCFF)
 

Guidelines and How to File:

  • Submit a Written Letter of Complaint outlining the charges to the Director of Categorical Programs. Form E (English) & Form E (Spanish)

Procedimientos Uniformes de Quejas!

Razones para presentar:

  • Incumplimiento de los programas estatales o federales Quejas de equidad educativa (discriminación ilegal, acoso, intimidación o intimidación de un grupo protegido)
  • Quejas relativas a las tasas ilegales de los alumnos
  • Programas de Ayuda Categórica Federal y Estatal
  • Fórmula de financiación de control local (LCFF)

 

Directrices y cómo presentar:

  • Presentar una carta de queja escrita en la que se describan los cargos al Director de Programas Categóricos. Formulario E (Inglés) y Formulario E (Español)
Identity of any complainant alleging discrimination will be kept confidential as appropriate.

Process:

  • Director of Categorical Programs, Lourdes Hale, will log the complaint and forward it to the Chief Academic Officer, Carmen Beck: possible mediation
  • Investigative meeting or other investigative processes will occur
  • Written report and decision sent to the complainant, Superintendent and Director of Categorical Programs (within 60 days)
  • Timelines and Appeals Process are outlined in the BP 1312.3 and AR 1312.3.

Policy: Complaints Concerning School Employees

Consultation Before Filing:

Reasons to File:

  • Employee operating outside their authority
  • Lack of good judgment
  • Inappropriate behavior
  • Professional performance issues

Guidelines and How to File:

  • Verbal or written complaints must have first been reviewed by the employee’s supervisor in an attempt to resolve the issues. They are confidential.
  • If unresolved: submit a Written Letter of Complaint to the Director of Certificated Personnel. Form C (English), Form C (Spanish)

Process:

  • Director of  Certificated Personnel will log the complaint and forward it to the appropriate Human Resources (HR) Administrator
  • Meeting with HR Admin
  • Investigation by HR Admin
  • Report of findings sent to the Executive Director of Human Resources for final decision
  • Written report and decision sent to the complainant, Superintendent and Director of Certificated Personnel
  • Timelines and Appeals Process are outlined in the BP 1312.1, 4031, 4144 and 4031 Policy and Rule and Regulation
 

Policy: Williams Uniform Complaint Procedures

Reasons to File:

  • Textbooks and instructional materials
  • Teacher Vacancy or Misassignment
  • Facilities
  • High School Exit Exam Intensive Instruction Services
 

Guidelines and How to File:

  • Submit an Official Williams Complaint Form D (English) or Form D (Spanish) to the Chief of Staff, form provided under Rule and Regulation E 1312.4

Process:

  • Lillian Grant will log the complaint and initiate an investigation
  • A response letter of findings will be sent to the complainant and involved parties
  • All Williams Complaints received are required to be publicly submitted to the Board or Education and County Supt of Schools
  • Timelines and Appeals Process are outlined in the 1312.4 Policy and Rule and Regulation
 

Site Assurance of Compliance:

  • English and Spanish versions of the following:
  • Williams Notice must be posted in every  K-12 Classroom.
  • CAHSEE Notice Must be posted in the office of schools serving grades 10-12
 

Policy: Complaints Questioning Instructional Programs and Supporting Operations

Consultation Before Filing:
K-12 General Education

Reasons to File:

  • Instructional Content/Techniques
  • Ineffective Programs
 

Guidelines and How to File:

  • Verbal or written complaints must have first been reviewed by teacher, principal, the supervisor or other appropriate administrators in an attempt to resolve
  • Submit an official Form to Tiffany Rudek, Chief Academic Officer. Form E (English), Form E (Spanish)

Process:

  • Director of Categorical Programs will log the complaint and forward it to the 1312.2 Hearing Officer
  • Hearing Officer will convene a hearing panel
  • Panel’s recommendation report is sent to the Supt to render a decision
  • Supt prepares written decision to be sent to all parties involved in the review process and the Director of Categorical Programs
  • Timelines and Appeals Process are outlined in the 1312.1 Policy and Administrative Regulation.
